Sub: Putting up of railing on the lawns in
front of flat No. B-121.
Dear Sirs,
This has reference to your notice dated 13/10/2023, asking us to dismantle the railings existing in front of our house and to limit it to boundary wall of our flat.
In this context I may point out that on 06/10/2023 the President of KVAOA, Shri O. P. Karan, alongwith certain persons, (the pack of prsons was conspicuous by the absence of any other Committee Member of the Society) came to my above quoted house, when my son was alone, and made a grave scene, by calling in police on the plea of law and order situation, misguiding the police themselves. The crime attributed to us by Shri Karan was that we had put up a railing on the lawn in front of our house. The railing was put up exactly as was done by a lot of other flat owners of all type of flats, as a security measure, since 1997 when Kendriya Vihar came into existence. The President told my son that it was an 'encroachment' and the railing should be dismantled. My son was a mere onlooker and the Police, finding that there was no law and order issue involved at all and the issue involved between the flat owner and the Society only, told the President and all other onlookers that the Police have no role to play in the matter and silently left the place. Here an apology from the President is due to me and my son for the unnecessary and deliberate, at the same time with ulterior motive, harassment meted out to us by childishly calling in the police by misguiding them, to disturb our peaceful life and stay and also for belittling us in front of our neighborhors. Tha act of Shri Karan was unbecoming of the status of the President of a well nown housing society like Kendriya Vihar, especially when he was well aware of the facts obtaining in the Socity about all so called encroachments (including that of his own) and real encroachments. I wonder whether the Society office bearers were simply sleeping all these years when so many other flat owners were erecting railings and other structures in front of their flats and real encroachments like those done by the former president and again by the present owner of B/483. How come Shri Karan himself had erected such railing when he was Secretary/ treasure of the Society during his earlier tenure and it was not an encroachment? One of the former Presidents had even put up a concrete structure on the common terrace, which is actually a real encroachment, and there was no problem at all?
I have put up the railing only during 2022 when the tricycle of my grandson was stolen from my doorstep and subsequently a costly new 7 feet high aluminium ladder, which was kept leaning on to the front verandah wall, was also stolen within hours of keeping it temporarily for cleaning the house, both during day time. This happened even while we are paying security charges to the Society. The theft was reported to the Security Officer Mr. Pandey, but nothing further happened. It was due to such happenings and purely on security considerations that we decided to put up railing on the lawns, exactly as was done by others, along with some internal renovation work which was already in progress. I may point out that while we were taking measurements for the work, Mr. Pandey had instructed us not to exceed the measurement and restrict it to other similar work in progress at that time at B/149 and B/250 etc. and, better to proceed after taking measurements of those railings, and we followed his instructions as such. It may also be pointed out here, that being the Security officer Mr. Pande himself let in all the materials for railings and the roof for the lawns, after examining them through the main gate.
As regards the present notice, I may state that I am prepared to dismantle the existing railings provided all other residents who put up similar railings earlier are also asked to dismantle them and they actualy start dismantling them first. I am demanding this only as a token of equal treatment being meted out to all residents, who pay society charges equally and favouritsm shown to none.
I hope the Society will ensure equality among the residents and none is isolated and harassed as I was treated badly by the present Society office bearers, especially by the President, Shri O. P. Karan.
This has also reference to my telephonic talk to shri Karan on 07/10/2023 on similar lines.
